I sent DMCA to The-Online.com web host which was ignored
One of the use who is using cPanel shared web hosting from The-Online.com web hosting company has infringed my copyright that I own about articles, images on my website. I had sent DMCA notice to The Online via email that your abuse address and it was just ignored. The said infringing website is still live on your server after 6 months for sending copyright removal request. All I got just one reply from your abuse department that the DMCA was forwarded to the customer. I had then sent 3-4 such notices again which I got same reply. The content was not removed or disabled from public access. Even I hired DMCA.com and paid them to sent legal DMCA notice and got same reply. Why The-Online.com after receiving dmca complaint does not remove copyrighted material from their customer’s website?
Hi Andrew, We at The-Online.com forward all the complaints directly received to us by email from copyright holders to our customers. It is up to them to address the issue. We only act on court orders to remove the content. DMCA is applicable only in U.S. jurisdiction and many of our customers opt Europe or Asia datacenter location where DMCA is ignored. But you can send copyright infringement notice as per European laws and we will forward it to our customer.
The-Online.com has become a safe haven for copyright infringers!! You don’t remove that content from your servers. I had send DMCA via Cloudflare as one of the site was hiding behind it. Cloudflare auto-forwarded the complaint to The Online’s abuse email and also provided me the name of web host and url of the web host. I then sent DMCA notice via email to this web host and I got a reply that they asked me for IP address for their user. Now, neither Cloudflare provides IP address of the copyright infringer nor The-Online.com can’t forward my DMCA notice to their user as they demanded IP address! I’ve sent them the concerned domain name and full URL and I got reply that they are not the one who decides if the content published on infringer’s website is reallly infringing or not, its the court who decides it. So now I’ve no option but to go in Court. Unfortunately they only accept Netherlands court order!
